As of July 1, 2009 legal persons in private law who are registered as temporary work agencies with the register of economic activities are authorized to provide temporary work agency service. The list of registered undertakings is available at  http://mtr.mkm.ee, "Otsingud" - "Registreeringu otsing" - "Renditööjõu vahendamine". 

Terms of registration as a a temporary work agency are regulated by § 38¹ and § 39 of  the  Labour Market Services and Benefits Act.

The definition of temporary agency work is set out in § 6(5) of the  Employment Contracts Act. Temporary agency work is a form of employment if the employer and the employee agree that the employee does work in compliance with a third party’s (user undertaking) instructions and supervision. Yet, the employment contract is concluded between the employer and the employee.

Registration proceedings to be registered with the register of economic activities are following:

1. payment of the state fee in the amount of 19,17 EUR to the account of the Ministry of Finance

Submission of the registration application

The registration application may be submitted to the Ministry of Social Affairs:

• by post on the address: Gonsiori 29, 15027 Tallinn or
• electronically on the e-mail address: info|ä|sm.ee (NB!  the application has to be digitally signed) or 
• via X-Road Company Registration Portal of the register of economic activities http://mtr.mkm.ee.

Completing the registration application

1. Clauses no 1, 4, 5 and 6 of the application shall be filled in. The application shall be signed by the authorized person. In case of legal persons the authorized person is a member of management board or an attorney (the power of attorney shall be submitted).

2. Temporary work agencies shall not fill in clauses no 2 and 3. An applicant may withdraw the application before the corresponding registry entry is made. State fee paid shall not be returned if the registration application is withdrawn.

The Ministry of Social Affairs shall register the undertaking within 5 working days. Notification of the entry shall not be given as the data of the register of economic activities are available to the public on the website http://mtr.mkm.ee.

The Ministry of Social Affairs must be informed within 5 working days about amendments of the registration data or termination or suspension of activity of the undertaking, see  homepage of the register of economic activities, application forms →   amendment of the registration.

The temporary work agency is required to submit, by 15 April each year,   confirmation concerning the accuracy of the registration (except if less than three months have elapsed after an undertaking is registered or a registration is amended) to the Ministry of Social Affairs. If an undertaking fails to submit confirmation concerning the accuracy of the registration, the registration shall be suspended as of May 1. An undertaking whose registration is suspended is prohibited to operate as a temporary work agency. If an undertaking submits confirmation concerning the accuracy of the data contained in the registration during the period May 1 – October 31 the Ministry of Social Affairs shall restore the registration within five working days. The suspended registration shall be deleted on November 1, i.e. after 6 months as of suspension of the registration.
